As a Salt Lake City DUI implied consent attorney, David Paul White helps individuals across Utah not only to understand implied consent and the various types of evidence brought against them, but also relentlessly defends them against the consequences of the criminal charges against them. Whether you were pulled over for alcohol consumption, underage DUI cases or a felony DUI, we can help.
What Is Implied Consent?
Many years ago, Utah implemented implied consent forms when an individual as young as 16 years of age gets his or her driver’s license. By signing this document to obtain a driver’s license, an individual is saying that he or she consents to taking urine tests, blood tests, breath tests and any other chemical tests to a law enforcement officer if he or she asks for it.
Unfortunately, at the Department of Motor Vehicles (DMV), this is not typically explained at length to the individuals who sign the document. When someone is pulled over, he or she is not always aware of his or her rights or how to protect them. While you are required by law to provide chemical samples, you are not required to perform a field sobriety test, and this is a right you should exercise when necessary.
No matter what, if you are pulled over for a DUI, you should speak with an attorney as soon as possible. If you do not adhere to certain timetables (i.e., requesting a per se, or administrative hearing, within 10 days of being pulled over), your license could be automatically suspended. Depending on the circumstances of your case, it may have been inappropriate for an officer to confront you with implied consent matters. We can help you protect your driver’s license and uphold your rights.
