When Is a Police Search Legal?
An individual, his or her residence, or his or her property, may be searched under certain circumstances:
- First, where there is a warrant for the search of a person, premises or property.However, the officers may not exceed the scope of the search as authorized by the warrant. In very limited circumstances, an officer may conduct a search under the exigent circumstances exception to the search warrant rule.
- Additionally, a search may be conducted incidental to an arrest. An officer must have probable cause that a crime was committed and that the person arrested committed the crime. An officer is then justified in searching the person, residence, vehicle or other property for evidence tending to prove the crime.
The laws of searches and seizures are very complex and fact specific. Many factors come into play.
