It is one of the most heinous crimes that happens far too often. Rape and sexual assault have torn apart the lives of thousands across Utah. Far too many rape cases are currently in limbo due to the huge backlog of rape kits at various crime labs. The victims are forced to live with the constant fear of an attacker that has yet to face justice. But it also affects many who are wrongly accused and are forced to wait for trial to clear their name and regain their freedom. To help put a stop to this growing problem, Utah Congresswoman Angela Romero (D-Salt Lake City)  is expected to introduce a new bill requiring the immediate testing of all rape kits throughout the state.

Under the new legislation proposed by Romero, a new database and tracking system would be created to monitor all rape kits. The system would allow rape victims to keep track of the status of their case. Proponents of the bills maintain it will help catch more sexual predators. In many cases, processed rape kits have been used to identify serial rapists. But rape is much more than just a physical attack, it also leaves devastating emotional scars. The proposed bill is also designed to provide closure rape victims.

Protecting the Rights of the Accused

There are nearly 1,400 untested rape kits sitting at the state’s crime lab. Each kit holds the fate of many potential victims and their accused attackers. Although the Romero’s bill is designed to help victims, it is also critical for many rape suspects. When a person is accused of rape, it can be extremely damaging to their reputation. Unfortunately, there is often a rush to judgment. Salt Lake City rape attorneys must always battle a strong bias against their clients. They must not only prove their innocence in a court of law, they must also prove their client’s innocence in the court of public opinion.

The Duke Lacrosse in 2006 was one of the most famous involving the exoneration of several young college students accused of rape. The case made huge national headlines and was often the subject of scrutiny from national legal commentators, including Nancy Grace. Many in the media had painted the Duke University lacrosse players as guilty before reviewing the actual facts of the case. Civil rights leaders the Reverend Al Sharpton and Jesse Jackson held rallies in support of the alleged victim, who was African American. But as the trial progressed, there became increasing inconsistencies with the prosecution’s case. It was later revealed the Durham County District Attorney Mike Nifong had helped conspire against the suspects.  Nifong also exploited the alleged victim Crystal Gail Mangum, who had struggled with mental illness.
