Should You Take Field Sobriety and Chemical Tests?
In Utah, field sobriety tests may include the horizontal gaze nystagmus (HGN), the walk and turn test, and the one leg stand test. By law, you are not required to take these potentially incriminating field tests. However, based on other factors, the officer may arrest you anyway. A preliminary breath test may also be administered on the roadside. Preliminary breath test results are often not admissible in court because the machines are unreliable and difficult to properly maintain.
As we investigate your case, we will review the squad car video to determine field sobriety test conditions and see how they were conducted. In many cases, we can argue that these tests are not scientifically reliable to prove impairment or were administered against approved police procedures.
Under Utah’s Implied Consent Law, your driving privileges may be suspended for a minimum of 18 months for refusing to submit to any breath or chemical tests requested by a police officer. The police must warn you that a refusal to submit to these tests may result in the suspension of your driver’s license for a specific period of time, based upon the circumstances of your case.
The results of breath, blood, oral fluids and urine tests can be suppressed for many reasons. Were they administered by personnel who were properly trained on the collection method and equipment?
