What Is a DUI/DWI Charge?

If you are pulled over by a police officer and a breath test shows a blood alcohol content (BAC) of .08 or higher, you will be charged with driving under the influence (DUI/DWI). However, blood alcohol levels below .08 can also result in unsafe driving charges in Utah. Additionally, you may be charged with a DUI if you have signs of being under the influence of drugs. The terms DWI (driving while intoxicated) and DUI (driving under the influence) are used interchangeably. The term DUI is more comprehensive in that the offense or violation charged might be drug induced (whether illegal or prescribed) and not necessarily alcohol-related.

Drunk Driving Penalties and Consequences

Driving under the influence of alcohol is a serious offense, and Utah has some of the most severe DWI/DUI penalties in the country. Even a first time offender faces stiff penalties, including a possible jail sentence, license suspension and a hefty fine. Repeat offenders are subject to a felony conviction and a possible five-year prison sentence. Other repercussions include an interlock device being installed on your car, which requires a blood alcohol monitor test every time you drive. This is in cases that do not result in your driver's license being suspended or revoked.

A drunk driving conviction can also result in job loss. If a conviction results in suspension or revocation of your license, you may or may not be issued a work permit. For people whose jobs require that they drive, this can cause serious problems. Even if it does not result in job loss, a conviction will appear on your permanent record, which can be seen by all future employers.

If going to trial is not your best defense option, you may have the option to enter into a plea agreement that may lessen the consequences of a DUI conviction. A conviction for Impaired Driving consists of admitting to facts that could result in a DUI conviction, but the consequences are favorable to the defendant if the terms of the plea and probation are successfully completed.
